1. 天维导购APP (hereinafter referred to as “we”, “us” or “the App”) complies with the New Zealand Privacy Act 2020 (the Act) when dealing with the personal information.

2. This Privacy Policy (“the Policy”) sets out how we will collect, use, disclose, process and protect any information that you provided when you use the App. Should we ask you to provide certain information, and you consent in giving the said information, it will only be used in accordance with the Policy and our term of use for the users.

3. In the Policy, "personal information" is any information about an identifiable individual (a natural person). It includes, without limit, name, address details, and personal preferences.

4. By using the App, you are deemed to have read, acknowledged and accepted all the provisions stated here in the Policy, including any changes we may make from time to time. We are committed to protecting the privacy, confidentiality and security of the user’s personal information by complying with applicable laws, including the user’s local data protection legislation. We are equally committed to ensuring that all our employees and agents uphold these obligations.

INFORMATION COLLECTED BY US

5. In order to provide our services to you, we will ask you to provide personal information that is necessary to provide those services to you. If you do not provide your personal information, we may not be able to provide you with our products or services.

6. We collect personal information about you from:

• you, when you provide that personal information to us, including via the website and any related service, through any registration or subscription process, through any contact with us (e.g. telephone call or email), or when you buy or use our services and product;


• third parties where you have authorised this or the information is publicly available.

If possible, we will collect personal information from you directly. 

7. We may collect the following types of information (which may or may not be personal information):

• Information you provide to us or upload (including your contact details): We may collect any and all personal information you provide to us, like your name, phone number, email address, phone numbers you insert into your contacts or messages sent, feedback, and any other information you provide us;


• Device-related information: Including information such as photos in the gallery and the contact information in your device;


• Your current geographical location;


• Your consent for us to use the camera of your devices;


• Your device information such as the operating system type and version, IP address and wireless connection information; AND


• Credit Card/Debit Card information inserted by you for any in-app purchasing.

HOW WE USE YOUR PERSONAL INFORMATION

8. Personal information is collected for providing services or products to you, and legal compliance on our part under applicable laws. You hereby consent that we may process and disclose personal information to our affiliated companies (which are in the communications, social media, technology and businesses).

9. We may use your personal information for the following purposes:

• to verify your identity;


• to provide services and products to you;


• to market our services and products to you, including contacting you electronically (e.g. by text or email for this purpose)


• to improve the services and products that we provide to you


• to bill you and to collect money that you owe us, including authorising and processing credit card transactions


• to respond to communications from you, including a complaint


• to conduct research and statistical analysis (on an anonymised basis)


• to protect and/or enforce our legal rights and interests, including defending any claim


• for any other purpose authorised by you or the Act.

10. Personal information may be collected when creating an Account on the App and profile page for the user.

11. We confirm that we do not sell any personal information to third parties.

12. We may disclose your personal information on occasion to third parties (as described below) in order to provide the products or services that you have requested.

SHARING WITH OUR GROUP AND THIRD-PARTY SERVICE PROVIDERS

13. In order to properly conduct our business operations and to provide you with the full functionality of our products and services, we may disclose your personal information from time to time to:

• another company within our group;


• any business that supports our services and products, including any person that hosts or maintains any underlying IT system or data centre that we use to provide the website or other services and products;


• a credit reference agency for the purpose of credit checking you;


• a person who can require us to supply your personal information (e.g. a regulatory authority);


• any other person authorised by the Act or another law (e.g. a law enforcement agency);


• any other person authorised by you.

14. We may disclose your personal information without further consent when required under applicable law.

15. For the avoidance of doubt, we may collect, use or disclose your personal information without your consent if it is and only to the extent it is allowed explicitly under the applicable data protection laws. Such disclosure may be brought about by the necessity to protect our rights, ensure the safety of you and other people, and comply with the requirements of the local government to facilitate the investigations of illegal activities.

RETENTION POLICY

16. Personal information will be held for as long as it is necessary to fulfill the purpose for which it was collected, or as required or permitted by applicable laws. We shall cease to retain personal information, or remove the means by which the personal information can be associated with particular individuals, as soon as it is reasonable to assume that the purpose for which that personal information was collected is no longer being served by retention of the personal information, including the cases when the personal information is no longer required for resolving legal disputes, applying our Agreements, or achieving our business goals.

INTERNET USE

17. While we take reasonable steps to maintain secure internet connections, if you provide us with personal information over the internet, the provision of that information is at your own risk.

18. If you post your personal information on the public chatroom/ platform in the App, you acknowledge and agree that the information you post is publicly available.

19. If you follow a link on our website to another site, the owner of that site will have its own privacy policy relating to your personal information. We suggest you review that site’s privacy policy before you provide personal information.

TERM OF USE

20. If you have agreed to our applicable Terms of Use, in the event of inconsistency between such Terms of Use and this Privacy Policy, such Terms of Use shall prevail.

UPDATES TO THE PRIVACY POLICY

21. We keep our Privacy Policy under regular review and may update this privacy policy to reflect changes to our information practices. If we make material changes to our Privacy Policy, we will notify you by email (sent to the e-mail address specified in your account) or post the changes through our software, so that you may be aware of the information we collect and how we use it. Such changes to our Privacy Policy shall apply from the effective date as set out in the notice or on the website. We encourage you to periodically review this page for the latest information on our privacy practices. Your continued use of the App will be taken as acceptance of the updated Privacy Policy. We will seek consent from you again before we collect more personal information from you or when we wish to use or disclose your personal information for new purposes.

ACCESSING AND CORRECTING YOUR PERSONAL INFORMATION

22. Subject to certain grounds for refusal set out in the Act, you have the right to access your readily retrievable personal information that we hold and to request a correction to your personal information. Before you exercise this right, we will need evidence to confirm that you are the individual to whom the personal information relates.
